Employment Tribunal Litigation including unfair dismissal and discrimination  claims
We have extensive experience of advising businesses on the full spectrum of  Employment Tribunal claims. Our clients also have the benefit of a senior fee earner handling the day to day conduct of any claim. One of the other issues faced by businesses in relation to Tribunal claims is that they have little cost certainty from their lawyers at the outset. To overcome this, we can offer a fixed fee quote on assessing each case. We find this gives businesses the information needed at the outset to determine the right strategy for the case given the potential liabilities, the costs of defending the case and whether the case poses any reputational risk to the business.
High Court Litigation – including enforcing employee restrictive covenants and confidentiality provisions
Our work in this area ranges from enforcing restrictive covenants and post termination restrictions against former employees to defending senior employees facing breach of confidentiality proceedings. Our team have significant experience of High Court work including acting for a leading intermediary broker on injunctive relief proceedings following the poaching of 10 traders by a competitor and advising an international business and its new employee on threatened injunction proceedings from the former employer.
Executive advice – including recruitment and termination of executives
We advise on a wide range of executive employment including boardroom disputes, bonus claims and recruitment and termination issues. These issues are often sensitive and have reputational issues for the business. We offer pragmatic and constructive solutions to businesses and executives alike.
Reorganisation and Restructuring – including collective redundancies and global changes to terms and conditions of employment
We have extensive experience of advising on all aspects of reorganisations and restructuring exercises. This includes redundancy exercises but also includes ways of avoiding redundancies such as the implementation of short time working or pay reductions. We have recently advised a listed company on a reorganisation exercise across two UK subsidiaries and a large logistics organisation on changes to terms and conditions of employment. We pride ourselves on bringing innovative and commercial solutions to these exercises as well as legal knowledge.
TUPE advice – we advise on all aspects of TUPE advice including on outsourcings, business and asset purchases and claims brought by employees under TUPE
We advise on all aspects of TUPE transfers including on business sales, asset purchases from businesses in administration and outsourcings. Our team has experience of advising on both national and international outsourcings and we advise a wide range of clients – from PLCs to SMEs on the impact of such transfers. We also advise businesses on failure to inform and consult claims and exercises to harmonise employee terms and conditions following a transfer.
General Advisory advice
We perform the full range of employment advisory work including drafting employment contracts, service agreements and compromise agreements. We can also provide a full range of employment documentation from policies and procedures to global employee handbooks.
Collective Employment advice – including advice on trade union disputes, negotiating collective agreements, recognition agreements and information and consultation bodies
We advise businesses on a wide range of collective employment issues. This includes negotiating collective agreements and recognition agreements with trade unions and advising on the establishment of employee consultation bodies. We also have extensive experience of advising on disputes with trade unions including union de-recognition, claims brought by trade union officers and advice on industrial action.
Discrimination advice – including advice on all aspects of employment discrimination legislation
Discrimination claims often have a reputational risk to a business. We have the expertise to deal with these claims in a way that protects your business and minimises the risk of any damage to your reputation. We have extensive experience of advising on the full range of discrimination claims including discrimination based on the grounds of sex, race, age, disability, sexual orientation and religion and belief.
